POST CONVICTION HEARING 2001 NOVEMBER 28TH, pg 33 Line 15 - pg 35 Line 17:

** New attorney for Clifton Badgett Jr is Mark J Rochon. On the stand answering questions is Clifton's former trial lawyer Louis Martucci. Let's read. **

ROCHON: Okay. And the girlfriend of Mr Badgett was interviewed by Detective Bernard Nelson in this case correct?

MARTUCCI: I think she was. I remember reading it as the first statement.

ROCHON: And so was the girlfriend's sister?

MARTUCCI: I believe - yes - she, the sister, and the mother.

ROCHON: All three of them interviewed by Detective Bernard Nelson?

MARTUCCI: They all gave statements. I don't know if it was Detective Bernard Nelson that took all three statements, but they were all interviewed.

ROCHON: They all three gave written statements, and all three written statements were consistent with what Mr Badgett said regarding where he said he was at the time of the homicide correct?

MARTUCCI: Uh, yes they were.

ROCHON: And indeed, the mother of Shynetra indicated that she had Caller ID on her phone and therefore they could even discern where Mr Badgett had called from correct?

MARTUCCI: Well she said that yes.

ROCHON: And as far as you know, Detective Bernard Nelson has not done anything - you've received no discovery that that was false about the Caller ID correct?

MARTUCCI: I was conveying information about the Caller ID.

ROCHON: And - ?

MARTUCCI: Other than the mother's statement.

ROCHON: All right. You didn't check to see if that was true?

MARTUCCI: No.

ROCHON: But in any event, what you had was Mr Badgett's statement given fairly shortly after the homicide as to an alibi and then these three women, each of whom corroborated correct?

MARTUCCI: Uh yes. Well, the womens statements - I'm not sure. What was the date of um the womens statements?

ROCHON: Mr Badgett January 29, the women - ; Your Honor can I just indicate for the record to make - I realize I don't normally answer questions (unclear speech) an examiner, but the 25th of 97 so stipulated. Maybe we can do it that way by stipulation. Their statements are given February 23rd.

PROSECUTOR MALONY: The State agrees.

MARTUCCI: If thats what it says then I can't disagree.

ROCHON: So my question to you then his alibi was given fairly shortly after the homicide at a time when he was in custody correct?

MARTUCCI: Yeah. I was aware of those statements.

ROCHON: And their statements corroborated his alibi as to where he was at the time of the shooting?

MARTUCCI: They did.
